Terms and Conditions

1. Acceptance of Agreement

By accessing or using the PhotoScout mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must immediately cease use of the App.

If you are using the App on behalf of a company or organisation, you confirm that you have authority to bind that entity to these Terms.

2. Nature of the Service

PhotoScout is a digital directory providing curated data relating to automotive photography locations, including but not limited to:

• GPS coordinates
• What3Words addresses
• General permit guidance
• Location notes and contextual information

PhotoScout provides informational content only. We do not guarantee the accuracy, completeness, or current validity of any location data.

Instagram Embeds

The App may display imagery or video content via public Instagram embeds operated by Meta Platforms.

• PhotoScout does not host, upload, or store embedded media.
• All intellectual property rights remain with the original content creators.
• Embedded content is subject to Instagram's own terms and may be removed or altered at any time.
• PhotoScout is not affiliated with or endorsed by Instagram or Meta.

3. No Warranty

The App and all content are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, PhotoScout makes no representations or warranties, express or implied, including but not limited to:

• Accuracy or reliability of location data
• Current validity of permit information
• Availability of any specific location
• Uninterrupted or error-free operation of the App
• Fitness for a particular purpose

Location conditions, ownership, access rights, and permit requirements may change at any time without notice.

4. User Responsibilities & Safety

Legal Compliance

PhotoScout may provide general permit guidance (e.g., “Permit Required” or “No Permit Required”). This information is provided for general informational purposes only.

You are solely responsible for:

• Verifying current legal access rights
• Obtaining necessary permits or permissions
• Complying with local laws and regulations

PhotoScout does not guarantee that any location is legally accessible.

Assumption of Risk

You access and visit locations entirely at your own risk.

PhotoScout is not responsible for:

• Personal injury
• Death
• Vehicle damage
• Property damage
• Trespassing charges
• Fines or penalties
• Losses arising from reliance on App data

5. Accounts and Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Misrepresent permit status to third parties
• Upload malicious code
• Attempt to gain unauthorized access to systems
• Interfere with App functionality

Anti-Scraping & Database Protection

The PhotoScout database is proprietary.

You may not:

• Scrape, crawl, or extract data using automated means
• Reverse engineer the App
• Reproduce, resell, or redistribute location data
• Create derivative databases
• Use the data for commercial resale or competing services

Unauthorized extraction or distribution of our coordinate database is strictly prohibited and may result in legal action.

6. Subscriptions and Billing

Subscriptions renew automatically unless cancelled prior to the end of the billing period.

All payments provide immediate access to proprietary digital content.

Except where required by applicable consumer protection laws, all sales are final and non-refundable.

You are responsible for managing subscription cancellations through your platform provider.

7. Termination

PhotoScout reserves the right to suspend or terminate access to the App at any time, with or without notice, if:

• You violate these Terms
• We suspect misuse or scraping
• Continued access presents legal or operational risk

Termination does not entitle you to refunds except where required by law.

8. Limitation of Liability

To the maximum extent permitted by law:

PhotoScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits
• Loss of business
• Loss of data
• Reputational harm
• Business interruption

In no event shall PhotoScout's total liability exceed the total amount paid by you to PhotoScout in the twelve (12) months preceding the claim.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

9. Force Majeure

PhotoScout shall not be liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to:

• Platform outages
• API restrictions
• Hosting provider failures
• Government actions
• Natural disasters
• Third-party service disruptions

10. Intellectual Property

All rights, title, and interest in:

• The PhotoScout name and logo
• App design and interface
• Curated database
• Written content

are owned exclusively by PhotoScout.

No rights are granted except as expressly stated in these Terms.

11. Changes to Terms

We may update these Terms at any time. Continued use of the App after updates constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and PhotoScout regarding use of the App.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
